4.2 The current situation and deficiency of China's protection of
virtual property of network games

Our country has no special law focusing on virtual property of network
games at the present time. The law officers can only turn to the
current law such as General Rule of Civil Law, the Constitution Law,
the Criminal Law and the like for legal foundations. To offer an
instance, the Article 13 of the Constitution Law stipulates that
private property owned by citizens shall be inviolable. The Article 4
of Decision on the Protection of Internet Security stipulates as
follows: For the sake of legal rights of individuals, judicial person,
and organization, anyone who violates the provisions of this Law, and
thus shall be investigated for criminal responsibilities according to
Law, shall be investigated for criminal responsibilities in accordance
with the provisions of the relevant laws. 【8】

4.2.1 Current situation and deficiency of China's protection of virtual property

Although the laws and regulations mentioned before can be used as
legal grounds in the protection of virtual property of network games,
some significant shortcomings still exist.

The "public or private property" introduced in Constitution Law does
not clearly include virtual property of network games, and at the same
time provide a clear definition for the character and status of the
virtual property of network games.

The extent of jurisdiction of Criminal Law is subjected to a narrow
range. So that cannot be applicable to the injurious acts of virtual
property of network games which emerges in endlessly.

The protections provide by Law on Protection of the Rights and
Interests of Consumers are not direct enough, meanwhile subject to a
narrow range.
