In respect to the Real-name System in South Korea, regarding that
China has attempted to set up real-name registration system, the
Real-name System has certain realistic instructions in China and is
worth being learned from (Lu & Dang, 2008: 14-17). Moreover, being in
the same Asian culture circle, China shares quite many similarities
with South Korea on cultural background and convention. Now that
Real-name System has achieved great success in South Korea, it
certainly works in China to some extent. Once this is adopted, the
balance between the right to Internet privacy and the right to free
speech has to be taken into consideration. So does the equilibrium
between human rights and state security.
As a matter of fact, self-regulation and legislation regulation
are not in conflict with each other at all and can co-exist in the
same society. Legislation prefers to protect individual rights but
might sacrifice free development of technology and e-business, while
self-regulation's flexibility complements flaws of legislation
regulation. The Safe Harbor system, first created by the United States
on the enactment of COPPA, is derived from the combination of
self-regulation and legislation. To put it in detail, when some
specific online service industry publishes its own guidelines on the
protection of the right to privacy on the Internet and these
guidelines are approved by the Federal Trade Commission, a safe harbor
is thus formed. So long as the ISP concerned complies with those
guidelines, it is regarded to have abided by the Federal regulation
and statute" (Qin, 2007: 196). The Safe Harbor system opens up a more
comprehensive direction to the protection of the right to Internet
privacy in China.
